NOURSE FARMS PRIVACY RIGHTS ACT

Nourse Farms (the “Company”, “we”, “us”, “our”) is providing this Privacy Notice (the “Notice”) to further the relationship between us and our customers. Personal information we collect about you

Personal information you provide directly to us. For certain activities, such as when consumers register, subscribe to our emailed or printed communications, or contact us directly, we may collect some or all of the following types of information:  

  1. Identifiers such as a real name, alias, postal address,unique personal identifier, online identifier, Internet Protocol address, e-mail address, account name, or other similar identifiers.
  2. Financial information - bank account number, credit card number, debit card number, or any other financial information, not including publicly available information that is lawfully made available to the general public from federal, state, or local government records. 
  3. Geolocation data. 
  4. Professional or employment-related information. 
  5. Inferences drawn from a consumer profile that was built with any of the information named above thatreflects theconsumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

How do we use personal information we collect from you?

 We may elect to use, share, sell or otherwise disclose the personal information we collect for one or more of the following purposes: 

 

  1. To fulfill or meet the reason for which the information is provided: fulfilling customer orders or sending communications such as emails and catalog requests. 
  2. To provide consumers with email or SMS alerts and other notices concerning our services.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing consumer notice.  


With whom we share your personal data and for what purposes:

  1. ‘Selling or Sharing’ List. In the preceding 12 months, we have NOT sold any personal information about consumers to third parties and have only shared limited data for the following two purposes:  credit checks upon request and due diligence pursuant to the restructuring of the company.

 

2.‘Disclosure’ List. In the preceding 12 months, we have disclosed the following categories of personal information about consumers to third parties for business purposes: Customer name, state, type, and sales information.

 

Assurance Against Unrelated or Incompatible Uses. We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing consumer notice. 


How do we safeguard your personal information? 

 We seek to protect personal information using technical and organizational measures based on the type of personal information and applicable processing activity.  We are committed to minimizing personal information collection to the information that is necessary for some defined purpose.  As part of our effort to safeguard personal data collected from you, we implement the following information security measures: 

 Having comprehensive security policies and procedures. 

  • Limiting the amount of personal information that we collect to strictly necessary only. 
  • Using ssl or other secure connection technologies when receiving or sending personal information beyond internal networks. 
  • Destroying the personal information that we no longer need. 
  • Performing regular information security risk assessments. 
  • Mitigating risks by following a risk treatment plan. 
  • Screening all employees with access to personal information. 
  • Providing regular information security awareness training to our employees. 
  • Requiring our employees to sign confidentiality agreements. 
  • Encrypting laptops and other portable media. 
  • Implementing and monitoring intrusion prevention and detection systems. 
  • Technologically separating systems containing personal information from public networks such as the internet. 
  • Maintaining up-to-date software and safeguards. 
  • Performing due diligence before onboarding our vendors. 
  • Performing regular due diligence of our vendors. 
  • Implementing physical security measures. 

Cookies and other trackers 

 Our website uses certain tags, log files, web beacons, and similar trackers from third parties (collectively, "Cookies"), of which you should be aware. Cookies are small data files stored on your hard drive or in device memory that help us to, among other things, improve the services and your experience. Web beacons are clear, electronic images that may be used on the services or in our e-mails and help deliver cookies, count visits, understand usage and campaign effectiveness and determine if an e-mail has been opened and acted upon. 


Children’s privacy

Our services/products are not intended for children under 13 years of age, and you must be at least 13 years old to have permission to use our services and/or access our website/application. We do not knowingly collect, use, or disclose personal data from children under 16. If you believe that we have collected, used, or disclosed the personal data of a child under the age of 16, please contact us using the contact information provided in this Notice, so that we can take appropriate action.

Access, correction and deletion of personal information and sensitive personal information 

You have the right to Access, Correct, and Delete your personal information across our business platforms, services, businesses, and devices. Right to Opt-Out

You have the right to opt-out from the sale or sharing of personal information at any time across business platforms, services, businesses, and devices. 

 

Limit the use of sensitive personal information 

You have the right to limit the use of your sensitive personal information, the unauthorized use of which creates a heightened risk of harm to you as a consumer across our business platforms, services, businesses, and devices. 

 

Request Information  

You have the right torequest the disclosure about collection, use, disclosure, and sale of personal information; you may request information beyond the 12-month collection period preceding the verifiable consumer request. 

You may request the disclosure ofthe following: 

(1) the categories of personal information it has collected about that consumer. 

(2) the categories of sources from which the personal information is collected 

(3) the business or commercial purpose for collecting, selling, or sharing personal information 

(4) the categories of third parties to whom the business discloses personal information 

(5) the specific pieces of personal information it has collected about that consumer 

 

Personal information should be disclosed free of charge to the consumer and provided through the consumer's account, by mail or electronically, within 45 days of receiving a verifiable consumer request from the consumer. The time required to verify whether the request is a verifiable consumer request does not extend this timeframe. 

If provided electronically, the information shall be portable and, if technically feasible, in a readable format allowing the consumer to transmit said information to another entities without hindrance. 

 

No retaliation or discrimination 

We do not discriminate against a consumer because of the exercise by the consumer of any of their privacy rights such as right to access, deletion or opt-out from sale or sharing of your personal information. This means that we will not, because of the exercise of consumer privacy rights granted to you: 

  • Deny goods or services to you 
  • Charge you different prices or rates for goods or services 
  • Provide you a different level or quality of goods or services 
  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

You may choose to exercise your privacy rights in any of the following ways:


Access, correction and deletion requests

To make a request for the access, correction or deletion of your personal information described above, please fill out this form, email info@noursefarms.com with Privacy Officer in the subject line or call 413-665-2658. We may request information from you in order to verify your request, such as your name, e-mail address, postal address, phone number, and then use that information to match it with information we already have. We may also ask you for additional identifiers and copies of your identifying documents, if we need additional information to verify your identity. We will confirm the receipt of your request via e-mail confirmation and start processing your request consistent with applicable law.

 

Authorized agent

If you would like an authorized agent to make a request for the disclosures, deletion or correction on your behalf, the agent may do so by filling out this form, emailing info@noursefarms.com with Privacy Officer in the subject line, or calling 413-665-2658. Upon receipt of a request by an agent, we will ask the consumer for written, signed permission that the agent has been authorized by the consumer to act on their behalf. Once written authorization is provided, we will start processing the request. We will respond directly to the e-mail address provided by the authorized agent regarding the fulfillment of the request.

Changes to this Notice

 This Notice is effective as of the Effective date above. We reserve the right to change this Notice at any time.
